  • How much is my water worth?

    Water values vary and depend on a variety of factors. These include whether the water can be applied toward for domestic (drinking water) use or strictly agricultural use, where the water can be used, and historical consumpive use. Market value can sometimes be difficult to determine, however recent sales comps and/or valuing on a per acre foot basis can help establish market valuation.

  • Can I buy water for investment purposes?

    Not exactly…Speculation is prohibited by the water courts but you can purchase irrigated land as an investment.

  • Can water rights be stripped from the land they are irrigating??

    Sometimes. It’s complicated. We can help you navigate this.

  • What is an Augmentation Plan?

    An augmentation plan serves as a method to enhance water supply, enabling individuals diverting water beyond their priority to compensate for such out-of-priority depletions. This can involve pooling water resources, exchanging water, utilizing substitute water supplies, or developing new sources of water.

  • What is a Dry-Up Covenant?

    A dry-up covenant is established when water rights tied to a parcel of land are sold for a different use. This agreement documents the historical consumption of the water right, ensuring that the equivalent amount of water historically utilized is transferred to the new owner. In return, the seller agrees to discontinue irrigating the land using water from the same system, effectively ceasing its water supply and preventing any adverse effects on other users within the system.
